At KMC Legal & Finance, we provide comprehensive support for Power of Attorney matters, understanding the varied needs of our clients. Power of Attorney is a legal document that allows an individual (the donor) to appoint one or more persons (the attorneys) to act on their behalf should they lose the ability to manage their own affairs.
KMC Legal & Finance aims to support clients with Power of Attorney matters. We understand that clients seeking Powers of Attorney are sometimes in difficult positions and emotional states, grappling with the prospect of diminishing capacity of their loved ones whilst needing to arrange matters relating to the health, welfare, finances, or property on a ticking clock.
At KMC Legal & Finance, we aim to be caring, supportive, communicative, and effective, delivering results to our clients quickly and with professionalism. We’re upfront about our fees, offering a fixed fee for all Power of Attorney matters so that you know up front how much you will need to pay, and we make sure that all our clients are satisfied with the work that we do, as may be demonstrated by our five-star rating on Google.
This type of Power of Attorney is suitable when the donor needs someone to act for them for a limited period or for specific financial or property transactions, and they have the mental capacity to manage their own affairs. An OPA is only valid while the donor retains mental capacity.
Also known as a Limited Power of Attorney, this allows the donor to grant authority to the attorney to manage specific issues only, typically for a one-time financial or legal act, often when the donor cannot be present to act themselves, such as selling property abroad or managing specific legal matters.
This is crucial for long-term planning. An LPA becomes effective when a donor loses mental capacity and can no longer manage their affairs independently. There are two types of LPA:
It's vital to recognise the importance of setting up an LPA early. Waiting until a medical diagnosis or an event that impacts one's capacity can often be too late, as the LPA cannot be registered once the donor has lost capacity. Arranging an LPA in advance ensures that your affairs can be managed according to your wishes without legal complications or delays.
